Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the website at zerodaymodel.com and the related API, console, and tools (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy (“AUP”), which are incorporated by reference. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind it, and “you” refers to that organization.
2. Accounts
- You may register with an email address and password. You are responsible for keeping your credentials and API keys secret.
- You are responsible for all activity under your account and API keys. If you suspect unauthorized use, delete affected API keys and change your password immediately.
- Email verification is required for live inference, checkout and community publishing.
3. The Service
The Service is an API gateway that routes your requests to third-party artificial-intelligence model providers and meters your usage. We do not create the underlying models. Model availability, capabilities, pricing, and output are subject to change and to the terms of the relevant upstream provider. We may add, modify, deprecate, or remove models at any time.
4. Acceptable use
Your use of the Service must comply with the Acceptable Use Policy and all applicable laws. The AUP sets out prohibited content and conduct. Violations may result in immediate suspension or termination and, where required, reporting to authorities.
5. Credits, billing, and payments
- The Service is prepaid. You purchase credits, which are reserved when you make a request and settled against the usage reported by the upstream provider.
- Payments are processed by third-party processors (e.g. Stripe for cards and NOWPayments (when enabled) for cryptocurrency). Your use of those services is subject to their terms.
- Except where required by law or expressly stated, purchased credits are non-refundable and have no cash value. Purchased credits do not expire. Monthly subscription credits expire at the end of the paid period and do not roll over. Pro includes €20 credits for €20/month; Plus includes €50 credits for €50/month and uses 5% fewer credits; Max includes €100 credits for €100/month and uses 10% fewer credits. Discounts apply to input and output usage during the paid period. Cards renew monthly until canceled; crypto, when available, purchases one month without automatic renewal.
- You agree not to initiate fraudulent chargebacks. We may suspend accounts, reverse credits, and record a balance owed for disputed, refunded, or charged-back payments.
- Prices and fees may change prospectively. Taxes are your responsibility unless stated otherwise.
6. Your content and AI output
- Your inputs. You retain ownership of the prompts, files, and other material you submit (“Inputs”). You grant us a limited license to process and transmit your Inputs to the selected upstream provider solely to operate the Service.
- Outputs. Subject to these Terms and upstream provider terms, you own the content generated in response to your Inputs (“Outputs”), to the extent such ownership is permitted by law. Outputs may be non-unique and similar content may be generated for other users.
- Your responsibility. You are solely responsible for your Inputs, for your use of Outputs, and for ensuring both comply with the AUP, applicable law, and any third-party rights. AI Outputs may be inaccurate, incomplete, or offensive; you must independently evaluate them before relying on them, and you must not present them as professional (e.g. medical, legal, or financial) advice.
Community publishing
Community publishing is free and requires a verified email. You keep your rights to your projects and grant the limited permission needed to host and display them according to your selected visibility. Public projects may be indexed by search engines; unlisted projects are accessible to anyone with their link; drafts are private to their creator. Downloads already made by others cannot be recalled. Do not upload credentials, personal data or material you lack permission to publish. Source files and ZIP archives are validated but are not certified malware-free and are never executed by the service.
7. Third-party services
The Service depends on third-party providers (model providers, payment processors, email, hosting, identity providers). We are not responsible for their acts, omissions, availability, or terms. Your use of features that rely on them may be subject to their separate agreements.
8. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. We do not warrant the accuracy or reliability of any Output.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY OUTPUT. Nothing in these Terms excludes or limits liability or statutory rights that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Third-party rights
You must have permission to submit and publish your content. Any responsibility for third-party claims is subject to applicable law and mandatory consumer protections.
11. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or the AUP, to protect the Service or other users, or as required by law. You may stop using the Service at any time. Provisions that by their nature should survive termination (including Sections 6–10, 12) will survive.
12. Applicable rights and disputes
Mandatory consumer rights and any rights to bring proceedings before courts available under applicable law remain unaffected. These Terms do not impose an arbitration requirement or waive class-action rights.
13. Changes
We may update these Terms from time to time. Material changes will be posted here with an updated date and, where appropriate, notified to you. Continued use after changes take effect constitutes acceptance.
14. Legal information
ZeroDay Model is the service name used on this website. It is not a representation of an incorporated legal entity. Operator identification and a dedicated legal contact are not currently published.
